Acceptable Use Policy

This Acceptable Use Policy (the "AUP") describes content and conduct that are prohibited on Dispatch (the "Service"). It is part of the Agreement between you and Audience Builders LLC ("Audience Builders"). Capitalized terms not defined in this AUP have the meanings given in the Terms of Service. You are responsible for your authorized users' compliance with this AUP. We may update this AUP from time to time as described in the Terms of Service.

1. Prohibited Content

You will not use the Service to create, upload, store, generate, publish, or transmit content that:

  • is unlawful, or that promotes or facilitates unlawful activity;
  • infringes or misappropriates any patent, copyright, trademark, trade secret, or other intellectual-property or proprietary right, or violates any right of publicity or privacy;
  • is defamatory, libelous, fraudulent, deceptive, or knowingly false or misleading, including disinformation intended to deceive the public;
  • is a deceptive synthetic media or "deepfake" that depicts a real, identifiable person in a false or misleading manner without clear and conspicuous disclosure;
  • promotes financial, investment, or cryptocurrency fraud, pyramid or multi-level-marketing schemes, or other deceptive money-making schemes;
  • is intended to interfere with elections or civic processes, including efforts to suppress participation or spread false information about when, where, or how to vote;
  • is hateful, harassing, or that incites or threatens violence, or that promotes discrimination against, or the harassment of, others;
  • is sexually explicit, exploits or endangers minors, or constitutes child sexual abuse material;
  • discloses another person's private, confidential, or personal information without authorization ("doxxing");
  • impersonates any person or entity or misrepresents your affiliation with any person or entity; or
  • contains software viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to any system or data.

2. Prohibited Conduct

You will not:

  • send spam or unsolicited bulk messages, or engage in inauthentic or manipulative activity, including coordinated inauthentic activity across accounts;
  • violate the terms, policies, automation rules, or rate limits of any connected third-party platform or content source;
  • access, tamper with, or use non-public areas of the Service, our systems, or those of our providers, or probe, scan, or test the vulnerability of any system or breach any security or authentication measure;
  • interfere with or disrupt the Service, including by overloading, flooding, or sending automated requests except through interfaces we expressly provide;
  • scrape, harvest, or collect data from the Service except as expressly permitted;
  • reverse engineer, decompile, or attempt to derive source code, models, or the underlying structure of the Service, except to the extent this restriction is prohibited by law;
  • resell, sublicense, or provide the Service to third parties except as expressly permitted; or
  • use the Service to develop or train a competing product or service.

3. Platform and Legal Compliance

You are solely responsible for ensuring that your content and activity comply with the rules of every platform you connect or publish to, and with all applicable laws and regulations, including those governing advertising, endorsements and disclosures, consumer protection, intellectual property, defamation, and privacy. A connected platform may restrict, suspend, or terminate your account for violations; we are not responsible for those actions.

4. Artificial Intelligence and Automation

You will not use AI-assisted or automated features, including Auto-Dispatch, to generate or distribute prohibited content, to impersonate real individuals in a deceptive manner, to create disinformation, or otherwise in violation of this AUP. Except where you enable automated publishing, you are responsible for reviewing and approving content — including automatically drafted content — before it is published. Where you enable automated publishing (including Auto-Dispatch), content is published without your individual review, and you remain responsible for all content published through automation you enable.

5. Enforcement

We may investigate suspected violations of this AUP and may take any action we consider appropriate, including removing or disabling content, throttling or limiting features, suspending or terminating accounts, and reporting activity to law enforcement or affected third parties. We may act with or without notice. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law. We are not liable for any action taken in good faith to enforce this AUP or the Agreement.

Our decision not to enforce a provision in a particular instance does not waive our right to enforce it later.

6. Copyright and DMCA Policy

We respect intellectual-property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. If you believe content on the Service infringes your copyright, send a written notice to our Designated Copyright Agent that includes:

  • your physical or electronic signature;
  • identification of the copyrighted work claimed to be infringed;
  • identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it;
  • your contact information (address, telephone number, and email);
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We may remove or disable access to allegedly infringing material upon receipt of a facially valid notice, without liability to any party, and will make reasonable efforts to notify the affected user.

Counter-notification. If you believe your material was removed by mistake or misidentification, you may send a counter-notification to the Designated Copyright Agent that includes your signature; identification of the removed material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address, and telephone number; and your consent to the jurisdiction of the federal court for your district (or, if outside the U.S., the U.S. District Court for the District of Maryland) and to accept service of process from the person who submitted the original notice. We may restore the material in 10–14 business days unless the original complainant notifies us that they have filed an action seeking a court order.

Repeat infringers. It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
